Archives.com "Family Recipe" Contest
The following Contest is intended for play in the United States only, and shall only be construed and evaluated according to U.S. law. Do not enter this Contest if you are not located in the U.S. at the time of entry.
The Archives.com "Family Recipe" Contest ("Contest") is open to all legal residents of the fifty (50) United States and the District of Columbia, who are the age of majority in his/her state of residence at the time of entry. Employees and their immediate families (parent, child, sibling or spouse) and/or household members of Ancestry.com Operations Inc., 360 W 4800 N, Provo, UT 84604 (the "Sponsor"), its respective parents, subsidiaries, affiliates, distributors, sales representatives, advertising and Contest agencies and any other persons or entities associated with this Contest (collectively, "Released Parties") are ineligible to enter or win. By participating, you agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize in contingent upon fulfilling all of the requirements set forth herein. Void where prohibited by law.
HOW TO ENTER: The Submission Period ("Submission Period") of the Contest will begin at 12:00:01 a.m. Eastern Standard Time ("EST") on December 10, 2012, and end at 11:59:59 p.m. EST on December 21, 2012. The Sponsor's database computer is the official time-keeping device for the Contest, as interpreted by Sponsor in its sole discretion. Eligible Entrants can enter the Contest by visiting the Sponsor's Website, http://www.archives.com (the "Website"). At the Website, Entrants must follow the links and instructions to complete the Contest registration form and submit a recipe with a story, either written or video, about a family recipe and why it is important to your family (the "Theme"). Submission of a Theme-related essay/video is a manditory portion of entry. Each properly completed and received Contest Entry form and theme-related essay/video submission (the "Entry") will receive one (1) Entry into the Contest. Once submitted, entries cannot be deleted, canceled, or modified. Limit one (1) Entry per person per email address during the Submission Period. Any violation or attempt to violate this restriction may cause Sponsor to disqualify all of such person's eligible entries. All entries must be received by 11:59:59 p.m. EST on December 21, 2012, in order to be eligible.
ADDITIONAL ENTRY REQUIREMENTS & RESTRICTIONS: The Entrant is responsible for all costs associated with the Entry. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor reserves the right to disqualify any person that submits more than maximum allowed entries. By participating in this Contest, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor which are final and binding in all matters relating to the Contest. By entering this Contest, Entrants agree that each Entry becomes the property of Sponsor and that the Sponsor may use the Entry for any proper promotional purpose. Any personally identifiable information collected during an Entrant's participation in this Contest will be collected by Sponsor and used by Sponsor, their respective affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules.
If a submitted Entry contains any material or elements that are not owned by the Entrant and/or are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who mentioned within the Entry (collectively, the "Clearances"). By submitting a completed Entry, the Entrant warrants and represents that he or she consents to the submission and use of the Entry in the Contest, and to its posting on the Internet in connection with the Contest.
Entries may not contain any of the following: i) Materials which include or constitute trademarks, trade names or copyrighted works created or owned by any person or entity other than Entrant or for which the Entrant has not obtained owner's permission to use; ii) Materials which contain profanities, or bearing the name or likeness of any celebrity, living or dead; iii) Materials which contain visible phone numbers, website links, street addresses, e-mail addresses or license plate numbers; iv) Materials which contain behavior inappropriate for a general audience; v) Materials which contain nudity or any depiction of real or simulated sexual acts; vi) Materials which contain extensive or gratuitous violence; vii) Materials which violate anyone's privacy rights, violate any confidentiality or employment agreement, or which are defamatory; viii) Materials which are derogatory to Sponsor, or any affiliated entity or person; ix) Materials which are discriminatory based on race, religion, national origin, physical disability, age, sex, or sexual orientation or preference; x) Materials in which any person identifiably appears where no appropriate written release has been obtained from such person granting all rights required herein; xi) Materials which do not comport with the Entry requirements. Entries which do not conform to these guidelines will be disqualified. Sponsor further reserves the right, in its sole and unfettered discretion, to verify at any time during the Contest that all necessary Clearances have been obtained and to disqualify and remove any Entry if it believes that the necessary Clearances have not been obtained.
WINNER DETERMINATION: At 11:59pm EST of December 21, 2012, the Submission Period will end. Each valid Contest Entry will be judged by a panel of judges appointed by the Sponsor ("Judges"), based on the clear relationship between the Entry and the following criteria: i) creativity of the video/essay (50%); ii) overall uniqueness of the family recipe story (50%) ("Judging Criteria"). All Contest Entries will be scored by the Judges after the Submission Period. The Grand Prize winner of the Contest will be the Entrant with the highest score according to the Judging Criteria, in the Judges' sole discretion. The First Prize winner of the Contest will be the Entrant with the 2nd highest score according to the Judging Criteria, in the Judges' sole discretion. Finally, the Second Prize winner of the Contest will be the Entrant with the 3rd highest score according to the Judging Criteria, in the Judges' sole discretion. All decisions of the Sponsor are final and binding. In the event of a tie, the Judges will reevaluate the Entries involved in the tie according to the Judging Criteria.
GRAND PRIZES: There will be one (1) Grand Prize, one (1) First Prize, and one (1) Second Prize awarded after the conclusion of the Contest. The Grand Prize winner will receive a $300 prepaid Visa gift card and an autographed copy of Gena Philibert Ortega's book "From the Kitchen: Discover Your Food Heritage and Preserve Favorite Recipes. The First Prize winner will receive a $200 prepaid Visa gift card and an autographed copy of Gena Philibert Ortega's book "From the Kitchen: Discover Your Food Heritage and Preserve Favorite Recipes. The Second Prize winner will receive a $100 prepaid Visa gift card and an autographed copy of Gena Philibert Ortega's book "From the Kitchen: Discover Your Food Heritage and Preserve Favorite Recipes. Total Prize Pool - $600 and three copies of Gena Philibert Ortega's book "From the Kitchen: Discover Your Food Heritage and Preserve Favorite Recipes.
No transfer of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value in the event that the aforementioned prize is not available. ALL POTENTIAL WINNERS MAY BE SUBJECT TO FURTHER VERIFICATION BY SPONSOR, WHO'S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner may be selected for the prize at issue.
GENERAL: By accepting the a prize, where permitted by law, the prize winners grant to the Sponsor, its respective parents, subsidiaries and related companies, and those acting pursuant to the authority of Sponsor (which grant will be confirmed in writing upon Sponsor's request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time a winner's full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL SPONSOR, ITS RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING AND CONTEST AGENCIES, DEALERS, DISTRIBUTORS, SUPPLIERS, PRIZE PROVIDER AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS CONTEST OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES.
By participating, Entrants release and agree to hold harmless the Sponsor, its respective parents, affiliates, subsidiaries, advertising and Contest agencies, dealers, distributors, suppliers, Prize provider and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Contest or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize(s). Sponsor is not responsible for incorrect or inaccurate Entry information, whether caused by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error, which may occur in the processing of the Contest entries. Sponsor is not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the Contest. Any personally identifiable information collected during an Entrant's participation in this Contest will be collected by Sponsor and used by, its respective parents, its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Contest and for marketing purposes as described in these Official Rules.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Contest, and randomly award the Prizes from among all eligible entries received as of such date should fraud, virus, bugs or other causes beyond the Sponsor's control corrupt the administration, fairness, proper play or security of the Contest. Sponsor reserves the right, at its sole discretion, to disqualify any individual (and all of his/her Contest entries) who tampers with the Entry process. This Contest is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the Utah. Any and all disputes will be individually resolved, without resort to class action, in the appropriate courts in the Utah exclusively, and subject to the laws of the Utah. Should there be a conflict between the laws of the Utah and any other laws, the conflict will be resolved in favor of the laws of the Utah. All federal, state and local laws and regulations apply. Winner acknowledges that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prizes.
