Ordinarily, birth records older than 100 years, and death and marriage records older than 50 years, are considered public. The County Clerk provides pre-1917 vital records and all divorce records. Named for General "Mad" Anthony Wayne, Brigadier General in the Continental Army, Wayne County was created in 1842 from Cabell County. After Wayne's command defeated a force of Indians at the Battle of Fallen Timbers, Indian chiefs signed "Wayne's Treaty" in 1795, ending major hostilities in present-day West Virginia and along the Ohio River.
